These Terms of Service govern your use of JoomVote, a Joomla extension. The provider is the responsible person named in the Legal Notice ("we", "us", "our"). By purchasing or using JoomVote, you agree to these terms.
1. License
JoomVote is sold as an annual subscription license. Upon purchase, you receive a non-exclusive, non-transferable license to install and use JoomVote on Joomla websites. The license is valid for one year from the date of purchase and renews automatically unless cancelled.
2. Payment and Billing
All payments are processed by Freemius, Inc., our authorized Merchant of Record. Freemius is responsible for billing, invoicing, and payment processing. By completing a purchase, you also agree to Freemius's Terms of Service. Prices are shown in EUR as net prices excluding applicable taxes. The applicable tax is calculated at checkout by Freemius and may vary depending on the buyer's location and VAT status.
3. Subscriptions and Cancellation
Annual subscriptions renew automatically. You may cancel your subscription at any time via the Freemius Customer Portal. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period, except as described in our Refund Policy.
4. Permitted Use
You may use JoomVote on websites you own or manage on behalf of clients. You may not redistribute, resell, sublicense, or share your license key. Use of JoomVote for unlawful purposes is prohibited.
5. Updates and Support
An active subscription includes access to updates and email support for the duration of the subscription period. We do not guarantee specific response times for support requests.
6. Disclaimer of Warranties
JoomVote is provided "as is" without warranties of any kind. We do not guarantee that the extension will be error-free or uninterrupted. To the extent permitted by applicable law, we disclaim all implied warranties.
7. Limitation of Liability
Our liability is limited to the amount you paid for the current subscription period. We are not liable for indirect, incidental, or consequential damages arising from your use of JoomVote.
8. Discontinuation and Interruption of the Product
Planned Discontinuation
We reserve the right to discontinue JoomVote on a planned basis. In such a case, we will notify registered users at least 90 days in advance via email and an announcement on joomvote.com.
As JoomVote is self-hosted software running on the user's own server and is not provided as a centrally operated service by us, the following applies:
- Existing subscriptions continue until the end of their paid term – no early termination or pro-rata refund will be issued.
- Automatic renewals will be deactivated as of the announcement date; no further charges will be made.
- The software remains fully usable for the user until their license expires.
- As of the discontinuation date, no further updates, security patches, or support services will be provided.
Force Majeure and Personal Incapacity
JoomVote is developed and operated by a single individual. In the event of serious illness, accident, death, or other circumstances beyond our control that make any announcement or active action impossible (force majeure), the following conditions apply:
- Advance notice is not possible in these cases and is not owed.
- Active subscriptions continue until the end of their respective term; billing continues to be handled by Freemius.
- The software remains usable in the version available at the time of the event; no further updates, bug fixes, or support are owed.
- No claims of any kind may be made against us, our heirs, or successors for refunds, damages, or continuation of the product.
By using JoomVote, you acknowledge that it is a software product operated by a single individual and that the subscription constitutes a license to use the software in its current state – not a guarantee of ongoing operation, updates, or support.
9. Changes to These Terms
We may update these terms at any time. Continued use of JoomVote after changes are published constitutes acceptance of the new terms.
10. Governing Law
These terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts at our place of business.
